Compliance (CAN-SPAM, CASL)

Mass communications are regulated. Ministrium implements compliance with CAN-SPAM (US), CASL (Canada), LFPDPPP (Mexico), and GDPR (EU) by default for members who live there.

Rules common to all laws

  1. Consent: the recipient must have given explicit opt-in or there must be a documentable prior relationship.
  2. Clear identification: the sender must identify themselves (church name + physical address).
  3. Unsubscribe mechanism: each mass message must allow opt-out with one click or by replying STOP.
  4. Honor opt-out: unsubscribes must process in ≤ 10 days (CAN-SPAM); Ministrium does it in seconds.
  5. Consent log: you must be able to prove when, how, and where someone opted in.

This is the gold standard: it proves the email is real and the owner consented. Enable it: Settings → Communications → Double opt-in.

That footer is injected automatically into every campaign. It cannot be disabled (the law doesn’t allow it).

CASL (Canada)

CASL is stricter than CAN-SPAM. Key differences:

  • Express or implied consent (last-24-month relationship).
  • Sender identification inside the body, not just the footer.
  • Fines up to CAD$10M per infraction.

If your church has members in Canada, enable CASL Mode in Settings → Communications: it blocks sends to contacts without documented express consent.

LFPDPPP (Mexico) and other local laws

Ministrium lets you download a consent record and delete on data-subject request in one click, complying with Mexico’s ARCO rights and analogous rights in Argentina (Ley 25.326), Brazil (LGPD), etc.

Compliance audit

CRM → Member → Consents shows a timeline: when each channel opt-in was given, when they unsubscribed, from which IP. That timeline is exportable as a signed PDF for an authority.

What your church must do

  1. Keep the church’s physical address up to date (Settings → Church).
  2. Capture consent when registering a new member (Ministrium forms already ask).
  3. Never import a purchased or unconsented email list — it’s illegal and damages your domain.
  4. Quarterly review members with opt_in_unknown and reconfirm consent.
  5. If a member asks for deletion, honor it within 30 days (Ministrium does it in hours).
